Terms of Service

Effective July 5, 2026. These terms cover your use of Philosomatika.fm and the Premium subscription.

1. The service

Philosomatika.fm ("Philosomatika", "we", "us") is a subscriber-funded internet radio station streaming psytrance since 1998. Premium gives you access to our channels in 256kbps with no advertising, in your browser or in any app that plays a stream URL. A free channel at lower quality, with occasional advertising, may also be available.

Internet radio is a live medium. We work hard to keep the streams up around the clock, but the service is provided "as is" and short interruptions can happen (see section 9).

2. Your account

Your email address is your sign-in name and how we reach you about your subscription. You are responsible for keeping your password and your private stream link confidential. Your subscription is personal: don't share your credentials or stream link, and don't use the service commercially (see section 7).

You must be at least 16 years old, or the age of digital consent in your country, to create an account.

3. Subscription, trial, and billing

Premium costs $5.95 per month (USD). New members get a 30-day free trial. After the trial, your subscription converts automatically to a paid subscription and renews every month until you cancel. You agree to this automatic renewal when you subscribe.

4. Cancelling and refunds

You can cancel anytime from your account page (or from your PayPal account, if you pay with PayPal). Cancelling stops future charges. You keep full access through the period you have already paid for, and your subscription simply does not renew.

Because you keep the access you paid for, we do not give partial refunds for the remainder of a billing period. If you believe you were charged in error, email support@philosomatika.fm and a human will look at it.

5. EU and UK consumers: your 14-day withdrawal right

If you are a consumer in the EU or UK, you normally have the right to withdraw from a digital service contract within 14 days without giving a reason.

When you subscribe, we ask for your express consent to start streaming immediately, and your acknowledgment that you lose the 14-day withdrawal right once performance has begun. We do this so you can listen right away instead of waiting two weeks. If you do not want to give that consent, do not complete the signup; you can contact support@philosomatika.fm instead.

This does not affect your other statutory rights as a consumer.

6. Music and intellectual property

All audio remains the property of its respective artists, labels, and rights holders. The station operates under a licensing model that covers its streaming. The Philosomatika name, logo, site design, and channel curation are ours.

Your subscription gives you a personal, non-exclusive, non-transferable right to listen. It does not give you any right to the underlying recordings.

7. Acceptable use

We may suspend or terminate accounts that break these rules. Where the breach is serious or repeated we may do so without refund of the current billing period.

8. Changes to the service and these terms

We may update the channels, features, and these terms over time. For material changes to the terms or the price we will notify you by email in advance. Continuing to use the service after a change takes effect means you accept it; if you do not, cancel and your subscription runs out at the end of the paid period.

9. Disclaimers and liability

The service is provided "as is" and "as available", without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation.

To the fullest extent permitted by law, our total liability for any claim connected to the service is limited to the amount you paid us in the 12 months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law, and nothing limits the statutory rights of consumers.

10. Termination

You can stop using the service and cancel at any time (section 4). We may suspend or close accounts for non-payment (section 3) or for breach of these terms (section 7). If we ever discontinue the service entirely, we will email you and you will not be charged again.

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, except where the consumer protection law of your country of residence gives you rights that cannot be waived.
